1. Introduction
Greetings from NeutralCommunityHub ("we," "us," or "our"). The following Terms & Conditions ("Terms") dictate how you may utilize our yacht charter services and our online platform at neutralcommunityhub.sbs, helmed by NeutralCommunityHub.
Your reservation of a yacht or your use of our platform signifies your consent to adhere to these Terms. Should you take issue with any segment of these terms, you are therefore refrained from utilizing the Service.
2. Service Overview
At NeutralCommunityHub, we deliver a selection of first-class yacht charter options, which include, among other offerings:
- Yacht leases for the day
- Evening sailing experiences
- Company getaways
- Exclusive gatherings
- Extended yacht trips
Our provision of services is reliant upon their current availability as well as climatic conditions. We retain the discretion to alter or cease any service without notice.
3. Reservations and Bookings
3.1 Process of Reserving
To reserve a charter, the following requirements must be met:
- Attain a minimum age of 18 years
- Submit valid and complete personal details
- Provide the necessary initial payment as indicated in the reservation confirmation
- Accept the Terms & Conditions outlined
3.2 Booking Confirmation
Confirmation of your reservation takes effect once payment is received along with our official written acknowledgement. We maintain the authority to decline service to anyone based on our judgement.
3.3 Charter Availability
Availability of charters is contingent on the accessibility of the vessel and favorable weather conditions. Efforts will be made in good faith to accommodate your requested scheduling.
4. Payment Terms
4.1 Pricing
The prices quoted are in € and tax inclusive unless specified otherwise. Prices are subject to modification without prior notice.
4.2 Payment Schedule
- Deposit: A required payment of 50% of the full cost for the charter is due at the time of reservation.
- Balance: The remaining amount must be paid 48 hours before the charter is set to depart.
- Additional fees (if applicable): To be settled after the charter service is completed.
4.3 Payment Methods
We accept a range of payment options including major credit cards, bank transfers, and certified cheques. All payments are processed using a secure and encrypted procedure.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If you cancel more than 72 hours prior to departure: You will receive a complete refund with the deduction of processing costs
- Cancelling between 24 to 72 hours before departure: You're entitled to a 50% reimbursement
- Cancellation less than 24 hours before departure: There will be no reimbursement issued
5.2 Weather Cancellations
Should our captain determine that weather conditions are not safe, we will propose to:
- Move your booking to the next open date without any additional fees
- Issue a complete refund if it's not feasible to reschedule
5.3 Mechanical Issues
If there are mechanical difficulties with the vessel you were assigned, we will strive to arrange an appropriate substitute. In the absence of a substitute, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
Every passenger is required to:
- Obey the instructions given by the crew
- Use safety gear when it is mandated
- Inform of any health issues that might impact their own safety
- Stay within the areas of the ship that are allowed for passengers
6.2 Prohibited Items
Items not allowed on the ship include:
- Bottles made of glass
- Banned substances
- Weapons or firearms
- Large quantities of beverages that are not in line with moderate consumption (replace with non-alcoholic drinks like juice or soda)
- Animals (except if they have been approved in advance)
6.3 Conduct
Passengers are expected to behave in a manner that is considerate of others. Should a passenger's actions create a safety concern or interfere with the enjoyment of others, we have the authority to end the voyage prematurely without issuing a refund.
7. Liability and Insurance
7.1 Our Liability
The extent of our liability is confined to the sum paid for your charter. Our liabilities do not extend to:
- Injuries to oneself due to personal negligence
- Theft or destruction of personal belongings
- Incidental, consequential, or exemplary damages
- Delays arising from weather conditions or other factors outside our control
7.2 Insurance Coverage
We have in place comprehensive marine insurance for our fleet and operational activities. It is up to passengers to arrange their travel and personal insurance coverage.
7.3 Assumption of Risk
Engaging in our charter services implies an acceptance of the intrinsic hazards associated with nautical activities, and you accept the onus for ensuring your own safety and security.
8. Modifications and Itinerary Changes
We hold the prerogative to alter travel plans, paths, or timetables due to climatic conditions, safety concerns, or necessary adjustments in operation. We shall strive to offer alternatives of similar value.
9. Force Majeure
We shall not bear responsibility for interruptions, deferrals, or itinerary changes that result from factors outside of our influence, including, but not confined to:
- Extreme meteorological phenomena
- Catastrophic events of nature
- Governmental stipulations
- Shutdowns of harbors
- Breakdowns of machinery
10. Privacy and Data Protection
We manage your personal details in line with our Privacy Policy. When you utilize our services, you agree to your data being collected and used as outlined in our Privacy Policy.
11. Intellectual Property
The materials on our site, such as texts, graphical elements, symbols, and photographs, are secured under the laws of copyright and trademark. Unauthorized copying, dissemination, or modification of these materials is forbidden without our express written consent.
12. Governing Law
These Terms are subject to the legal jurisdiction of Spain. Should any legal issues arise, they will be adjudicated in the courts situated in Barcelona, Spain.
13. Changes to Terms
We have the authority to alter these Terms at any point. Any adjustments will be made available on our website with the new revision date indicated. Your continued use of our services implies your agreement to the amended terms.
